Protections for the Community Spouse

Community Spouse Resource Allowance (CSRA):
Minimum: $31,290
Maximum: one-half of countable assets up to $123,600
Increased CSRA:
Permitted if ordered by a court, or by a state administrative hearing officer. New Mexico follows the income-first rule.
Annuities:
Annuities must be actuarially sound. No balloon payments. The regulation has been updated to reflect the DRA but is not yet publicly available.
