Medical Marijuana Not Allowed at Nursing Home

A nursing home resident with multiple sclerosis is not allowed to smoke marijuana at his nursing home even though he is on Vermont's medical marijuana registry, according to the Associated Press. Vermont's medical marijuana registry theoretically allows Shayne Higgins to possess and smoke marijuana, but when the nursing home found a marijuana cigarette in Higgins's room, it called the police, who confiscated the cigarette. Higgins uses the marijuana to help with pain and to stimulate his appetite.
The Associated Press reports that the nursing home does not allow marijuana on the premises because it receives federal funds and the federal government does not recognize Vermont's medical marijuana law. The U.S. Supreme Court ruled in June that state laws don't protect users from federal prosecution.
