Can a Medicaid Applicant Who Died Before Eligibility Notification Still Receive Benefits?

My husband was in an Illinois nursing home and had applied for Medicaid but died before he received notification of his eligibility. What happens now regarding eligibility and the payments I made during the “pending” period?

I am sorry to hear about your husband’s passing. Unfortunately, I can’t tell you exactly how this works in Illinois. In Massachusetts, where I practice, you would still be able to pursue the Medicaid application and be reimbursed for any covered service you pay for. It just may take some advocacy on your part. An Illinois elder law attorney could advise you on how this works in your state.
