If an Elderly Unsafe Driver Is Involved in a Car Crash, Are Her Adult Children Liable?

  • September 17th, 2013
Mom is an unsafe driver but will not give up driving. If she has an accident, can her children be sued for not stopping her from driving?

Children are not liable for their parents’ actions unless the children participated in some way. So, if your mother gets into an accident, you will not be legally responsible if you didn’t provide her with the car or help in any other way. That said, you might want to do what you can to protect other drivers and pedestrians by disabling your mother’s car are making a report to the Department of Motor Vehicles, especially if she has dementia and it is worsening.
