Can a State Limit a Medicaid Applicant’s Funeral Expenses?

  • January 9th, 2024
Q
I've applied to Medicaid. Is the state where I live allowed to limit the amount that I can spend on funeral services for my deceased loved one? If so, where can I get help paying for the services we want?
A

Money spent on funeral arrangements is allowed under Medicaid’s rules. The type of funeral an individual chooses and how much it costs should be no business of the Medicaid agency, but they nevertheless might limit the amount spent if they seem to be unreasonable based on average funeral expenses. In other words, the Medicaid agency may impose their standard of what they deem to be reasonable. Check your options to keep costs down.

What Does the Average Funeral Cost?

Read our article about how Medicaid helps cover funeral costs. Funerals are expensive, but you can talk to the funeral home for state resources and advice on how to keep costs down. There may be charitable organizations or state and local funds available, too. Do you or your loved one have an inexpensive funeral expense policy?

You can always contact an elder law attorney familiar with your state laws and local resources.
