Will or Living Trust?



Although a "simple will" sounds like an easy, "no frills" way to "leave your estate," a will may not meet the needs of you and your family. A will does not avoid probate when you die. A will guarantees probate.

A will only controls after you die. It offers no protection should you become physically or mentally incapacitated. The court would become involved for your affairs to be managed, and your family would endure a "living probate," a time consuming, expensive and public court procedure.

A living trust is an easy, proven alternative to a will. It prevents probate, and allows you to keep control of your assets while living - even if you become incapacitated - and after you die. It is your set of instructions to:
  • Control what you have while you are alive and well,
  • Provide for you and your beneficiaries just as you would yourself should you become unable to do so,
  • Give what you have to who you want, when you want, and in the way that you want, and,
  • To accomplish your goals at a minimum overall cost to you and your family.
