MassHealth Acknowledges Promissory Note
In a recent MassHealth case the Office of Medicaid acknowledges a promissory note and rolls back the penalty period by a full year from their inital denial.

The case involved a 91-year-old nursing home resident who transferred $244,000 to his niece in August 2006, putting his assets below $2,000 for MassHealth eligibility.  Subsequently an application for MassHealth benefits was filed in September 2006 at the Revere MassHealth Enrollment Center which denied it due to the transfer.  Upon filing an appeal, in November 2006 the niece converted $89,000 of the transferred assets into a promissory note in compliance with the DRA, and completed a "partial cure" in the amount of $18,700, paying her uncle's nursing home through November 2006.

The Board of Hearings on appeal subtracted the the value of the entire value of the promissory note ($89,000) from the disqualifying transfer ($244,000) and acknowledge the partial cure, resulting in an adjusted transfer of $135,700.  Ultimately, the orginal penalty period was rolled back almost a full year.

This succesful outcome validates the use of promissory notes.  However, it is still not clear whether the Office of Medicaid will postpone the penalty period start date upon reapplication because the promissory note payments are being used to pay the nursing facility.
